CEMA Co-Hosts Conference on International Security Interests in Mobile Equipment with UNIDROIT and the Government of Japan

On Wednesday, September 25, 2024, the International Institute for the Unification of Private Law (UNIDROIT), the Ministry of Justice of Japan, and CEMA jointly hosted a workshop on the Cape Town Convention and MAC Protocol.

The Convention and Protocol create an international security interest in high-value mobile equipment, which already covers aircraft, railway rolling stock and space assets. Discussions are currently underway around the world on the MAC area, which stands for Mining, Agriculture, and Construction Machinery.

Mr. Norio Hatano, Counselor, Civil Affairs Bureau, Ministry of Justice, gave opening remarks, and Mr. Ignacio Tirado, Executive Director of UNIDROIT, and Mr. Hideki Kanda, Director Emeritus, University of Tokyo, gave keynote speeches on the outline of the system and international trends. This was followed by a two-part panel discussion.

In the first panel, Professor Emi Hara of Chuo University, Japan Representative of UNIDROIT's MAC Protocol Preparatory Committee, and other panelists gave lectures on the economic impact and legal status of the MAC Protocol.
In the second panel, under the theme of “Industry, Regional, and Global Perspectives on the MAC Protocol,” the impact on the construction machinery industry and the measures that Japan should take in the future were discussed, and Mr. Koyama, Executive Director of CEMA, was one of the panelists.

After that, Mr. William Brydie-Watson, Senior Legal Officer, UNIDROIT, gave a lecture on “The Future of the MAC Protocol and the Importance of Japan”, and Mr. Fukushima, Chairman of the Planning and Coordination Division of the International Committee, gave closing remarks on behalf of the CEMA.

In the speech and discussion, many participants pointed out the need for the Japanese government and industry to work together to ensure fair competitive conditions with construction equipment manufacturers in other countries, and to take proactive measures in anticipation of ratification.
